(RTTNews) - Teva Pharmaceutical Industries Ltd. (TEVA | charts | news | PowerRating) announced that the United States Court of Appeals for the Federal Circuit has denied Novartis' (NVS | charts | news | PowerRating) emergency motion for an injunction pending its appeal of a September 5 District Court preliminary injunction ruling in favor of Teva. Teva can resume sales of its generic Famciclovir Tablets, AB-rated to Novartis' Famvir Tablets.

Earlier this month, Teva said that US court of Appeals for the Federal Circuits allowed an injunction on the sale of generic Famciclovir Tablets, AB rated to Novartis' Famivir Tablets.

The Injunction will remain in place pending consideration of Novartis' motion for a stay pending appeal. Teva said it would respond to Novartis' emergency motion on September 11.
