Energizer Holdings, parent company of Eveready Battery Co., claims the lithium batteries imported and sold by Spectrum subsidiary Rayovac, based in Madison, infringe on two Eveready patents.
Energizer said it is seeking undisclosed damages from Spectrum Brands and has asked for an injunction to stop sales of the lithium batteries.
Spectrum Brands said in a written statement it will "vigorously defend itself" against the allegations. The company said it recently introduced the lithium batteries "to provide consumers with a lower cost alternative," and said sales of the product are not expected to have a material impact on the company's 2008 or 2009 financial results.
Spectrum Brands' stock closed Monday at $2.52, down 24 cents or 8.7 percent.
