Lilly sued Cobalt Laboratories Inc., Impax Laboratories Inc., Sandoz Inc. and Wockhardt Ltd. The company filed the lawsuit after the companies filed abbreviated new drug applications to make and sell duloxetine hydrochloride capsules before Lilly's patent expires in 2013.
Cymbalta, which is the brand name for duloxetine hydrochloride, was launched in 2004. Its patent expires the same year Lilly faces patent expirations for the cancer drug Gemzar and the insulin Humalog. The Food and Drug Administration has approved Cymbalta to treat major depressive disorder, diabetic peripheral neuropathic pain, generalized anxiety disorder and fibromyalgia. The drug posted $716 million in sales during the third quarter, a 40 percent increase over the same quarter last year.
