Faith Sinclair, an honors student at Ridley High School, was crossing Chester Pike in Sharon Hill on her way to a sleepover Aug. 3 when she was hit by a black Mercedes-Benz that left the scene.
Payne, of Upper Darby, owner of the car that police believe was involved, was arrested in October and charged with leaving the scene of the accident, tampering with evidence, and related offenses.
During the hearing, Alex Penman, who was the boyfriend of Sinclair and was with her that night, took the stand.
"I heard a screech and loud bang," Penman said. He had crossed the street, and when he heard the noise, he said, he turned back to see Sinclair "rolling off the car."
Penman said he was not sure if the "screeching" he heard was car brakes on pavement or a scream.
Police received a tip that Payne was the owner of the Mercedes that had struck Sinclair, and that the car was in Payne's garage, according to an affidavit. Upper Darby Detective George Rhoades Jr. said yesterday that police found the damaged Mercedes covered with tarps in the garage.
"There was no doubt it was human hair embedded in that windshield," Rhoades said.
Kimberly Ferrell, the victim's mother, broke down and wept at that point. She eventually left the courtroom.
Payne's supervisor at the Deer Park water company in Pennsauken said that he and Payne spoke on Aug. 6 after the suspect did not show up for work.
"He told me, basically, he got himself into trouble," Marc Stephens said. "He had been involved in an accident where he hit a girl and she died."
The next day, Stephens said, Payne called back and told him not to tell anyone about their conversation.
When the hearing ended, Sinclair's distraught brother, Alex, was carried out of the courtroom in a bearhug by a family member. Alex's mouth was being covered as he tried to yell.
As Payne left the court, he was greeted with shouts of "coward" and some obscenities from Sinclair's family as TV crews followed him to his car.
"Nothing can bring her back. There is no justice," said Richard Sinclair, 70, of Broomall, Faith Sinclair's grandfather. "He has to live with it, and he knows it."
