San Bernardino County sheriff's Deputy Kent Watson feared for his life when Ibn Rasheed Jones aimed a gun at him, according to the San Bernardino County District Attorney's Office.
"The fatal shooting of Ibn Jones was a justifiable homicide by a public officer in the performance of his duties. No reasonable jury could find otherwise," prosecutors wrote in a report.
The deputy came to 12550 Amargosa Road on July 8 because Jones, a 20-year-old Victorville man, was fighting with his former girlfriend. Prosecutors said the woman, who was holding the couple's infant daughter, became upset when she smelled marijuana in Jones' car.
She later told investigators Jones was a drug dealer. Authorities found packaged marijuana in his vehicle and more than $300 in cash in his pockets, prosecutors said.
Sheriff's investigators said Jones, reputedly a member of an Inglewood gang, ran from the deputy and climbed over a fence separating Amargosa and the 15 Freeway. Deputies believe he dropped a .40 caliber handgun stolen in Los Angeles when he jumped down from the fence.
Jones held the gun sideways and pointed it toward the deputy, prompting the deputy to fire twice. The deputy said he believes he missed Jones. Jones continued running while
reportedly still pointing the gun at the deputy.
Watson fired another three rounds at Jones, who eventually collapsed and died at the scene, prosecutors said.
San Bernardino County coroner's officials said bullets struck Jones in the forearm, his back and buttocks. A bullet also grazed Jones on his hip.
Several people at a nearby Jack in the Box saw different portions of the incident, including one man who said he thought Jones was facing away from Watson when the shooting began. Several more claimed they didn't see Jones holding a gun.
But prosecutors said the witnesses were all 30 to 40 yards away from the fence and that with it being dark outside, the deputy was in a better position to spot a firearm on Jones.
