Car-Freshner, which is headquartered in the Jefferson County Corporate Park, filed a stipulation of discontinuance Friday in U.S. District Court ending its action against Old Navy LLC, San Francisco, and The Gap Inc., which does business as Old Navy Clothing Co.
Senior Judge Thomas J. McAvoy approved the filing Wednesday. Terms of the settlement were not disclosed by the parties.
Car-Freshner filed a trademark infringement suit against Old Navy in March, claiming the retailer had sold T-shirts containing a tree design that is "identical to" Car-Freshner's trademarked design, which is used by the Watertown company on car fresheners, apparel, stuffed toy animals and other items.
