TEIJIN PHARMA SUES TOWA OVER GENERIC DRUG'S CONTAINER

TOKYO, Jan 19, 2009 (AsiaPulse via COMTEX) --
TWAPF | Quote | Chart | News | PowerRating -- Teijin Pharma Ltd. said Friday
that it has filed suit in the Tokyo District Court against Towa
Pharmaceutical Co. (TSE:4553), alleging that a container design
used by the generic-drug maker are too much like its own.

Towa makes a generic version of Teijin Pharma's Rhinocort
Powder Spray for Nasal Use, a hay fever remedy. Teijin Pharma
accused Towa of engaging in unfair competition because the
shape and dispensing method of the drug's container bear too
close a resemblance to its own, causing Towa's product to be
mistaken for Teijin Pharma's.

The Teijin Ltd. (TSE:3401) subsidiary is asking the court to
order Towa to cease production and sales of the products in
question and is also seeking 8 million yen in damages.

Towa representatives said they could not comment because
they have not yet seen the document.
