NOTICE TEXT: Department of Commerce National Institute of Standards and Technology (NIST) Acquisition Management Division The National Institute of Standards and Technology (NIST) in Gaithersburg, Maryland intends to negotiate and award a purchase order using simplified acquisition procedures on a sole source basis under the authority of 41 USC 253 (c) (1), with Bruker AXS, Inc. in Madison, WI for a service agreement for one (1) Quantex XFlash silicon drift detector and software, Model #4040. Bruker AXS, Inc. is the only source that can provide maintenance for this equipment as the technology and parts are proprietary to Bruker AXS, Inc. Bruker AXS, Inc. has no distributors. The resulting Purchase Order will be for a base period of one (1) year with four (4) one year option periods. The North American Industry Classification System (NAICS) code for this acquisition is 811219, and the size standard is 500. No solicitation package will be issued. This notice of intent is not a request for competitive quotations, however, responses received by April 14, 2009 will be considered by the Government. A determination by the Government whether to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
