The lawsuit alleges that the company "knowingly and repeatedly" disregarded the state's underground fuel storage laws, putting groundwater at risk. Among the specific charges is that the company failed to have adequate containment and detection equipment for hazardous materials stored in underground tanks.
Brown's staff noted that a legal action filed in mid-2008 by Riverside's district attorney sought an injunction against the company for its handling of hazardous materials in underground tanks. TravelCenters countered that the applicable law is unconstitutional, pre-empted by federal law and a violation of due process.
Company representatives could not be reached for comment Tuesday.

Vicorp Restaurants Inc., former owner of the Bakers Square chain known for its extensive selection of pies, filed for Chapter 11 bankruptcy protection last year and in March sold the chain and a sister company, Village Inn pancake houses. The buyer was American Blue Ribbon Holdings LLC, a new private entity formed by Fidelity National Financial Inc. and Newport Global Advisors. The new owner also is based in Denver.
At the time of last year's bankruptcy filing, Vicorp had 267 restaurants in 25 states. American Blue Ribbon did not return repeated telephone calls requesting comment, but a press release on the Bakers Square Web site says the company will continue to operate the Village Inn and Bakers Square restaurant brands as well the VICOM pie operation.
