NASCAR has stated repeatedly the lawsuit must be resolved before any realignment requests are considered.
"I've tried to actually shame (the former owners) into it because they have a moral responsibility, I believe, because the state of Kentucky spent $96 million there on assisting in building that speedway," Smith said.
"There's 96 million reasons right there they ought to drop that lawsuit. We've been drawing this out too long already."
Smith said he was unsure how much longer NASCAR would be willing to wait for a resolution of the appeal.
"I don't know how quickly this can be resolved," Smith said. "It depends on whether NASCAR wants to be so gracious to (wait) and I don't know."
