CVS, Longs settle California complaint

Jun 11, 2009 (The Sacramento Bee - McClatchy-Tribune Information Services via COMTEX) -- LDG | Quote | Chart | News | PowerRating -- Customers who find expired merchandise on the shelf at CVS Pharmacies or Longs Drug Stores can get $2 store coupons, part of a novel settlement reached Wednesday with California Attorney General Jerry Brown.

The agreement was filed in San Diego Superior Court, stemming from a lawsuit filed by Brown against CVS Caremark Corp., the owner of Longs.

Brown's office, which launched an investigation in March 2008, found that the pharmacy chain violated state codes by "routinely" selling expired baby food and formula, over-the-counter medications and dairy products. Some were 11 months past their expiration dates.

The coupon agreement is the first of its kind, according to Brown's office, and awards $2 store coupons that can be used at any California CVS or Longs store for any merchandise.

Signs detailing the coupon offer, which begins in 90 days at CVS stores and in 150 days at Longs, will be posted in both stores, said Scott Gerber, a spokesman for Brown.

CVS also agreed to twice-monthly checks on infant and baby food, eggs, dairy products and over-the-counter medications; proper shredding of confidential documents; and payment of $975,000 in penalties.

CVS Pharmacies, the nation's largest pharmacy chain, announced in August that it was purchasing Longs Drug Stores, which has 25 stores in the Sacramento region. Brown's investigation centered on CVS stores in Los Angeles, Orange and San Diego counties.

The same investigation found that five CVS stores improperly discarded 500 pieces of customers' confidential medical information in trash bins, according to Brown's office.

In a written statement, a spokesman for CVS Caremark, based in Woonsocket, R.I., said the settlement involved "isolated violations" of the company's policy.
