Jun 26, 2009 -- Ormco Corporation, a subsidiary of Danaher Corporation (NYSE: DHR), announced today that it received a favorable jury verdict in its patent infringement case against Align Technology, Inc., the maker of Invisalign(R), a clear, removable appliance used to straighten teeth. The jury unanimously found that Align's process for creating its Invisalign(R) aligners infringed several claims of a patent held by Ormco. The claims at issue cover a process for creating 3D representations of the teeth of a patient for use in modeling tooth movement, a technique used in orthodontic treatment.
In addition to finding Align infringed the patent claims asserted by Ormco, the jury rejected Align's assertions that the claims at issue in the lawsuit were invalid and unenforceable. "We are pleased that the jury reached a verdict in favor of Ormco," said Don Tuttle, President of Ormco Corporation. He then added that, "We have long maintained that Align's process for creating aligners used our intellectual property and that the attacks on the enforceability of our patent claims were unfounded."
The Court has not yet entered judgment in the case. Although Ormco expects that Align will file post-trial motions with the Court trying to alter the jury's decision, Ormco believes a judgment on the verdict will be entered. Following the entry of the judgment on the verdict, Ormco will be entitled to request the court issue a permanent injunction to enjoin Align's continued infringement and to seek a reasonable royalty on all of their US sales made since January of 2003 by Align of its Invisalign(R) aligners.

(NASDAQ: OMTR), a leading provider of online business optimization software, today announced that Improvement Direct, a leading home improvement retailer, is using Omniture Test&Target(TM) together with Omniture SiteCatalyst to improve the performance of its network of ecommerce Web sites. Improvement Direct selected Omniture Test&Target for its ability to conduct unlimited A/B and multivariate testing from one single application and tie directly into its analytics application, SiteCatalyst. After running several A/B and multivariate tests on its site with Test&Target, the retailer was able to recover lost revenue related to restocking costs and also increased revenue per visitor (RPV) by nearly 33 percent and average order value (AOV) by almost 38 percent.

Improvement Direct employed Test&Target to help recover the restocking costs associated with accepting returns on large items such as bathtubs and armoires. In the past the company did not charge customers a restocking fee for these returned items, even though it always incurred a cost with each return. The retailer ran an A/B test with messaging highlighting a 15 percent restocking fee for any returned products with the goal of recovering its costs without impacting customers' propensity to buy. The test demonstrated that the restocking fee did not positively or negatively affect purchases, leading the company to display the restocking fee messaging across the site, knowing it could now recover the expenses associated with any returned products that it was previously writing off as a cost of doing business.
Improvement Direct also used Test&Target to set up a series of multivariate tests, to determine whether offering fewer payment methods impacted sales positively or negatively. Results indicated that when the retailer removed a specific group of payment methods, it saw RPV increase by nearly 33 percent and AOV increase by almost 38 percent. This prompted the company to omit these payment methods in order to increase revenue.
"Omniture Test&Target showed us that removing particular payment options increased our sales metrics, an insight we wouldn't have gained without multivariate testing," explains Proctor. "We have now embraced testing as part of our culture. We take new ideas and test them online so our shoppers can help us make the best decision for our business through their actions."
