The proposal, denied last month by the TPZ, called for two buildings with a total of 16 residential units on a 1.33-acre site between Kings Highway on the east and Kings Highway Cutoff on the west.
Lawyer Charles Willinger filed the appeal in Bridgeport Superior Court on behalf of 2180 Kings Highway DE, LLC, whose principal is listed as 2180 Kings Highway LLC. The managing partner of 2180 Kings Highway LLC is Louis Ceruzzi Jr.
In turning down the zone change and subsequent special permit and coastal site plan, the TPZ in June ruled a zone change isn't warranted and would promote a level of development that would not protect property values in the neighborhood or enhance the community.
Several neighbors, however, spoke in support of the zone change for the residential development. They said they prefer a residential development on the site rather than commercial.
According to Willinger's appeal, about two-thirds of the property is in a designed industrial district, with the only access from the third of the property in a residence B zone. The town's zoning regulations, Willinger said, do not permit a driveway to give access to any industrial district property through a residentially zoned parcel.
The town, after some debate
at the Representative Town Meeting, had previously abandoned a paper road that ran through the parcel, giving it to the developer. In turn, the developer made a $50,000 donation to the Parks and Recreation Department.
