The PBGC will terminate the plans effective July 31, 2009, and will have all of the rights and powers of a trustee specified in ERISA or otherwise granted by law.
Having finalized the PBGC-Delphi trustee agreement, the PBGC has withdrawn its district court action seeking appointment as trustee and approval to terminate the several pension plans.
