USPTO Grants Mercury Cable & Energy's Petition for Reexamination of Composite Technology Corporation's '162' and '319' Patents for Composite ACCC Core

DANA POINT, Calif., Aug 25, 2009 (BUSINESS WIRE) -- CPTC | Quote | Chart | News | PowerRating -- Mercury Cable and Energy ("Mercury") is pleased to announce that the United States Patent and Trademark Office ("USPTO") has granted its Request for Ex Parte Reexamination of Composite Technology Corporation's (OTCBB:CPTC.OB) ACCC patents for bare overhead transmission wire (U.S. Patent No. 7,368,162 (Patent "162") and U.S. Patent No. 7,211,319 (Patent "319"). In the USPTO Order granting Reexamination dated August 17, 2009, the Patent Examiner stated "It is agreed that newly cited [prior art] raises a substantial new question of patentability" regarding the '162 and '319 Patents.

According to statistics provided by the USPTO, seventy five percent of reexamined patents are either invalidated or one or more claims are rejected. Additionally, according to USPTO statistics, the reexamination process generally takes between 24 and 48 months.

Prior to the USPTO action the Federal Court granted Mercury's request to stay patent infringement proceedings between Composite Technology Corporation and Mercury Cable & Energy (Case number SACV 09-261) pending USPTO review of the '162 and '319 patents.
