Silldorf & Levine, LLP Files Construction Defect Litigation for Defective Windows

SAN DIEGO, Sept 14, 2009 /PRNewswire via COMTEX/ -- IAL | Quote | Chart | News | PowerRating -- The law firm of Silldorf & Levine, LLP recently filed a Complaint for Construction Defects in the Superior Court of San Diego County against Davidson Communities, International Window Corporation and other defendants. The Plaintiffs own single-family homes in Meadows Del Mar, a community in the Carmel Valley area of San Diego.

The homes in the Meadows Del Mar development were built by defendant Davidson Communities in 2001. The Complaint in this matter alleges that the homes in the Meadows Del Mar community have defective windows and French doors. The plaintiffs are suing Davidson Communities, International Window Corporation, International Aluminum Corporation and J&B Manufacturing Corporation.

The plaintiffs allege claims of strict liability, negligence, breach of implied warranties, and breach of express warranties. The Complaint centers on defective windows. The windows were designed and manufactured by International Window Corporation and International Aluminum Corporation in a manner that allows water to get between wood joints which causes them to deteriorate prematurely and causes water damage to the interior walls and finishes of their homes. The homeowners have fallen victim to a systematic failure of their window systems.

Firm principal Scott Levine plans to focus his investigation on the complete chain of distribution of the window, including the designer and manufacturer of the wood windows (International Aluminum Corporation and International Window) and the window supplier/installer (J&B Manufacturing Corporation). Mr. Levine explains, "When a defective product is put into the stream of commerce, all commercial entities placing a product in that stream are strictly liable to the consumer/homeowner. Strict Liability is liability without proof of fault. The law provides that the commercial entities in the stream can fight amongst themselves who is at fault, but for the homeowner consumer, they may collect their damages from any or all of the commercial entities in the stream." This lawsuit is a second generation window case against these defendants. In 2008 Mr. Levine represented four homeowners in Meadows Del Mar with the same problems. That case was settled after depositions of the manufacturer were completed. The settlement total was significant but confidential at the request of the defendants.

Mr. Levine concentrates his practice representing consumers who have defective windows. He has represented homeowners and associations in construction defect cases since 1991. Recently Mr. Levine successfully settled what is likely the largest window settlement in the State of California (on an amount per house basis) days before trial was set to begin.
