The Federal Energy Regulatory Commission's staff gave its approval to a project proposed by Texas Eastern, a division of Spectra Energy.
The proposal includes a new 26.5-mile pipeline through eastern York County that would connect an existing pipeline in Peach Bottom Township to another in Marietta, Lancaster County.
A recommendation from FERC staff bodes well for the project, since the commission, which makes the final decision, typically follows its staff recommendation.
Texas Eastern formally proposed the pipeline to FERC in February, although the company began its "pre-filing" process in July 2008.
Several well-attended public meetings were held last year in York County to explain the effort. About 270 local landowners could be affected.
Connect: Texas Eastern's goal is to connect a pipeline it owns with a second line owned by ConocoPhillips to increase natural gas capacity to the northeastern United States, where demand is growing.
In offering its approval, the FERC staff agreed the project would serve a public need and determined the environmental impact of the project could be kept to a minimum, said FERC spokeswoman Tamara Young-Allen.
She said the commission typically follows the staff recommendation but can also follow a different course. For example, it can request more information or reject the proposal outright.
If the commission gives
its approval, Texas Eastern will have the right to use eminent domain to acquire rights of way necessary for the project, Young-Allen said.
Comments: Affected landowners and other stakeholders in the project have until Oct. 13 to submit their comments on FERC staff's decision, according to the report. A decision from the commission could come in December.
The approval would be subject to appeal , Young-Allen said. She said any approval would likely be contingent on a variety of requirements Texas Eastern will have to meet before and during construction.
Spectra Energy is reviewing the staff decision, said Marylee Hanley, director of stakeholder outreach. She said it will submit its own comments by the deadline.
She declined to discuss when the company hopes to complete the project.
"We have to take this one step at a time," she said. "This is the next step in the process."
