The division bench comprising Chief Justice of SHC, Sarmad Jalal Usmani, and Justice Rukhsana Ahmed issued the directives after hearing the comments from both sides.
The court directed the KESC for publishing the loadshedding schedule as early as possible. Counselling for KESC, Barrister Kumail Ahmed Sherazi argued before the court that the company obtained only 50 per cent electricity from different sources including Wapda, Karachi Nuclear Power Plant (KANUPP), Pakistan Steel, and Independent Power Producers (IPPs), therefore KESC has not able to generate enough power to fulfil the need of the consumers.
He explained that some times the units of power generation declined unexpectedly, similarly, the reduction of gas supply from the concern institution, overloading on grid stations, demand of more electricity and the tripping of feeder also resulted in power failure. The court inquired him that why the loadshedding occurred on late night hours. Sherazi replied that usually the power supply fails due to shutdown, while the said reasons were also behind the electricity breakdown.
The plaintiff Iqbal Kazmi submitted that the consumers are suffering due to unannounced hours-long power outages. He added that KESC officials had not informed the people through advertisement. However the KESC officials only published the advertisements about electricity shutdown, Kazmi added. He referred the Electricity Act 1910, clause 24 in which the electric supply could not be suspended without informing the consumers.
He also claimed that KESC had been provided subsidy of Rs one billion by the government after its privatisation, but now the company wanted to get such subsidy again.
He further claimed that the KESC management wanted to create law and order situation in the metropolitan by provoking the people to create turmoil. The petitioner also submitted that despite of issuing directions by the President of Pakistan Asif Ali Zardari in recent, power outages are still witnessing in the metropolitan. When the President was in City, loadshedding was controlled but soon after his departure the citizens again suffering such prolong power outages. The petitioner made respondents to Federal Secretary of Water and Power, KESC, Chairman of Wapda and National Electric Power Regularity Authority (Nepra).
