Neal Conway, whose last known address was James Island, S.C., pleaded guilty recently to two counts of second-degree forgery.
He is expected to be ordered to pay $550 in restitution for the checks he cashed and $2,232 to reimburse the state for the cost of his extradition.
Sentencing was set for Monday, Nov. 16.
Conway could spend a total of two years in County Jail or serve five years of probation, or he could go to state prison for up to seven years if the pre-sentence Probation Department report ordered by County Court Judge Robert G. Main Jr. reveals serious issues.
Conway was indicted by a grand jury on Oct. 30, 2008, but left the area. He was later arrested in South Carolina and extradited to New York.
In addition to a charge of petit larceny for stealing a stack of checks from Geoffrey and Teresa Smith of Saranac Lake, he was indicted on 14 counts of second-degree criminal possession of a forged instrument for having the checks and 14 counts of second-degree forgery for signing and cashing them.
The crimes occurred between Feb. 28 and March 8, 2008.
The checks were cashed on these dates for the stated amounts: Feb. 28 for $21.65; March 3 for $40.97 and $40.89; March 4 for $42.41; March 5 for $40.87; March 6 for $42.06, $41.67 and $43.83; March 7 for $40.89, $34.95, $41.69, $40.67 and $35.79; and March 8 for $42.27.
Defense attorney Aaron Edwards asked Main to release his client under probation so Conway could stay with relatives in Saranac Lake while he awaits sentencing.
Assistant District Attorney Gary Pasqua strongly objected, saying Conway remains a risk for flight because he left once before and now knows he could get jail or prison time.
The judge set bail at $15,000 cash or $30,000 insurance bond to hold Conway, reminding him that if he is bailed out and leaves again, he could go to prison on these counts and have more time added for bail jumping.
