The settlement ends a sexual harassment lawsuit filed in August 2008 by the U.S. Equal Employment Opportunity Commission in U.S. District Court in Scranton that alleged more than a dozen female employees were sexually harassed by general manager Christopher Mendoza and others.
The harassment included making crude sexual propositions to women, frequently making sexually explicit and graphic remarks to them about their appearance, and making lewd comments in their presence about female customers, the suit said. The EEOC said that some of the women harassed were teenagers.
"Sexual harassment is always unacceptable, but when some of the victims are vulnerable teenagers, it is especially unconscionable," EEOC Acting Chairman Stuart J. Ishimaru said in a released statement.
The agreement, filed Oct. 30, says the following payouts to former employees will be made by Ruby Tuesday: $101,000 to Michelle Gydosh; $32,000 to Melissa Johnson; $57,000 to Rosemary Singer; $60,000 to Dawn Kovacs and $5,000 to Nicole Wallace.
The company said it will also provide annual training on sexual harassment to all managers and supervisors at the Stroudsburg site and require the redistribution of its policy against harassment to all employees at the location. It will also post a notice regarding the settlement.
"The consent decree resolves egregious harassment," said EEOC acting regional attorney Debra Lawrence. "It also addresses the broader issues of how to prevent a recurrence of such harassment. The EEOC believes all Ruby Tuesday employees in Stroudsburg will benefit from the supervisory accountability provisions and training provided for in the decree."
The settlement does not indicate if any action has been taken against Mendoza.
