The bicyclists reached the agreement with Eau Claire City Attorney Stephen Nick before a trial was scheduled to start this month.
Eau Claire police issued $20 citations to 17 bicyclists on May 30 for improperly riding on the road during rush hour. The riders were part of a loosely organized international movement called Critical Mass, which involves a monthly bicycle ride to celebrate cycling and assert cyclists' right to the road.
An Eau Claire police officer saw the group riding two abreast in the right-hand lane of southbound Hastings Way near Main Street at about 5:22 p.m., according to a police report. The officer pulled up behind bicyclists who were stopped at a red light at Highland Avenue and asked them to pull into the nearby Burger King lot.
The officer advised the bicyclists they couldn't impede traffic, but they "insisted it was their 'right' to bike on Hastings Way," the officer wrote in his report.
Because the bicyclists had been warned in the past, police ticketed them.
In June interviews, several members of the group said they didn't believe they were impeding traffic.
Three of the bicyclists ticketed entered no contest pleas, and 14, including Andrew Werthmann of Eau Claire, pleaded not guilty. The cases involving Werthmann and seven others, were scheduled for trial Nov. 5, but the trial was canceled after the agreement was reached.
"I think we realized that there are lawful ways to cycle on the street," said Werthmann, one of the eight who reached the agreement.
"We're (still) serious about standing up for cyclists in the city," he said. "We feel that cyclists' rights should be (acknowledged)."
