On May 13, U.S. District Judge Richard Smoak found the school had violated Gillman's right of free speech by restricting the wearing of symbols and T-shirts in support of gay rights.
"I just wanted to put my belief out there that gays and lesbians should be accepted by everyone and not ridiculed," Gillman, 17, said at the trial.
Gillman, backed by the American Civil Liberties Union, sued the Holmes County School Board after her cousin, who is openly gay, and several others were suspended between Sept. 21 and 24, 2007, for "expressing their support for the fair treatment of gays and lesbians," according to her complaint.
Gillman wanted the right to wear T-shirts to school with slogans supporting gay rights and with gay pride symbols, which then-principal David Davis had prohibited. The School Board argued it had the right to suppress free speech if it could lead to disruptions in learning.
Smoak rejected that argument and said the school missed an opportunity for teaching and discussing the issues. A few months later, he released a written ruling blasting Davis for what the judge characterized as a witch hunt.
Davis was removed as principal and assigned to a teaching position after Smoak's ruling.
According to a press release, the Playboy Foundation on Sept. 23 named Gillman as one of three winners of the 2008 Hugh M. Hefner First Amendment Award. There were more than 60 nominees.
"All across the United States, brave men and women are standing up to protect our First Amendment rights from attacks by the forces of political opportunism, religious intolerance and quasi-governmental interference," Christie Hefner, chairwoman and CEO of Playboy Enterprises Inc., said in the release.
"I know the examples set by the winners of the 2008 Hugh M. Hefner First Amendment Awards will inspire everyone who cares about our precious American legacy of civil liberties."
The awards will be presented Tuesday at a ceremony in Washington, D.C.
