A dramatic late in the day rally brought stocks back from staggering losses on Monday. The Dow was down more than 800 points intraday.

The Dow closed down 369.88. The Nasdaq Composite lost 84.43. And the S&P 500 fell by 42.34

Citigroup (C | Quote | Chart | News | PowerRating) has sued Wells Fargo (WFC | Quote | Chart | News | PowerRating) and Wachovia (WB | Quote | Chart | News | PowerRating) over the former's attempt to buyout the latter. Citigroup claims to have a prior deal with Wachovia for rights to portions of the troubled lender.

Costco (COST | Quote | Chart | News | PowerRating) announces quarterly earnings Tuesday morning before the market opens. Analysts are expecting EPS of 0.93.

Eli Lilly (LLY | Quote | Chart | News | PowerRating) agreed to buy ImClone Systems (IMCL | Quote | Chart | News | PowerRating) for $6.5 billion. Bristol Meyers Squibb (BMY | Quote | Chart | News | PowerRating) will drop its hostile bid for the company.
